Genes improperly granted patents

Some time mid last year six breast cancer patients sued reputed Myriad Genetics, a company that holds patent of two vital genes BRCA1 and BRCA2 that play a role in increasing the risk of breast and ovarian cancers. The fees that the company charges for these genetic tests is a whopping $3,000 which these women claim they cannot afford and the most important of all these women cannot get a second opinion regarding the tests since no one else does them.

Teva Pharmaceutical Industries settles generic eloxatin patent infringement litigation

Teva Pharmaceutical Industries Ltd. announced today that patent infringement litigation pertaining to Teva's generic version of sanofi-aventis and Debiopharm's Eloxatin (oxaliplatin injection) has been dismissed by the United States District Court for the District of New Jersey pursuant to a settlement between the parties.

Metabolon awarded U.S. patents for metabolomics methods

Metabolon, Inc., the leader in global metabolism through biomarker discovery and analysis, announced today the grant of US Patent 7,682,783 and US Patent 7,682,784 entitled "Methods for Drug Discovery, Disease Treatment and Diagnosis Using Metabolomics". The USPTO awarded the patents to Metabolon on March 23, 2010. The issued claims in the new patents are for uses of metabolomics to identify diagnostic biomarkers for depression and schizophrenia by profiling classes of metabolites in a sample.

Court rules against gene patents

The New York Times: A judicial ruling that "threw out parts of two gene patents and called into question thousands more" has biotechnology executives hastening "to reassure their investors that the ruling would not necessarily undermine their businesses, at least in the short run. But the executives themselves were struggling on Tuesday to figure out what the long-term impact would be."

Japanese Patent Office grants Alnylam Pharmaceuticals' claims in second patent application for Tuschl II

Alnylam Pharmaceuticals, Inc., a leading RNAi therapeutics company, announced today that the Japanese Patent Office has granted claims in a second patent application (JP Application Number 2006-317758) for the Tuschl II patent series, entitled "RNA Interference Mediating Small RNA Molecules." In May 2008, the Japanese Patent Office granted a related set of claims in the Tuschl II patent series (JP 4 095 895).

USPTO issues Notice of Allowance for menadione to prevent skin rash in patients taking EGFR inhibitors

The New York Times: A federal judge Monday threw out two patents on human genes that are linked to breast and ovarian cancer. "The decision, if upheld, could throw into doubt the patents covering thousands of human genes and reshape the law of intellectual property."

Court rules certain claims covering isolated DNA sequences in patents covering BRACAnalysis as invalid

Myriad Genetics, Inc. today announced that Judge Robert W. Sweet of the Federal District Court for the Southern District of New York ruled that certain claims covering isolated DNA sequences in seven of the 23 patents covering BRACAnalysis® are invalid. Myriad will appeal the decision to the Court of Appeals for the Federal Circuit and will continue to vigorously defend this litigation.

Appeals court ruling clears way for Enzo Biochem to pursue claim for substantial damages against Applera

Enzo Biochem Inc. said today that a decision released Friday by the Court of Appeals for the Federal Circuit reversing a district court's summary judgment will enable the Company to pursue a claim for substantial damages against Applera Corporation, now Life Technologies Corporation. AGA Medical Holdings, Inc. today announced the settlement of a patent infringement lawsuit between the company and Medtronic, Inc. This dispute relates to the January 2007 patent infringement action against the company, filed by Medtronic, Inc., alleging that substantially all of AGA Medical's AMPLATZER® occluder and vascular plug devices infringe three of Medtronic's method and apparatus patents on shape memory alloy stents (U.S. Patent Nos. 5,190,546, 6,306,141 and 5,067,957, collectively known as "the Jervis patents").

Federal Circuit affirms validity of Pressure Products’ patent infringement case against Greatbatch Medical

In the most recent development concerning Pressure Products’ patent infringement case against Greatbatch Medical’s valved, peelable introducer product line, The United States Court of Appeals for the Federal Circuit has affirmed the rulings of United States District Court for the Eastern District of Texas that Pressure Products’ patents are valid and enforceable. In a split decision, the Federal Circuit remanded the case to the District Court for further proceedings concerning Greatbatch’s infringement of Pressure Products’ patents.
