U.S. PTO grants reissue patent concerning OSI Pharmaceuticals’ Tarceva

OSI Pharmaceuticals, Inc. today announced that the U.S. Patent & Trademark Office (PTO) has granted reissue patent RE41,065, replacing Tarceva’s® (erlotinib) composition of matter patent (formerly No.5,747,498). The Company had applied for the reissue patent in February 2008, and on September 17, 2009 the Company had announced that the PTO had issued a “Notice of Allowance” accepting the Company’s application to correct certain errors relating to the claiming of compounds, other than Tarceva, which had fallen outside of the scope of the main claim of the patent.

Retractable Technologies, Inc. OMI (Occupational & Medical Innovations Limited, an Australian public company,) in favor of Retractable on all claims presented to the jury.

Amgen and Roche end EPO patent infringement dispute

Amgen announced today that the United States (U.S.) District Court in Boston has entered final judgment and a permanent injunction against Roche prohibiting Roche from infringing Amgen's patents on recombinant erythropoietin (EPO), thus bringing the five-year patent infringement dispute to an end.

Hologic, Inc. Amylin Pharmaceuticals' modified exendins and exendin agonists patent: USPTO issues Final Office Action

ConjuChem Biotechnologies Inc. announced today that the U.S. Patent & Trademark Office (USPTO) has issued a Right of Appeal Notice (Final Office Action) in the inter partes reexamination of Patent No. 6,924,264. The patent, entitled "Modified Exendins and Exendin Agonists," was issued in August 2005 and is assigned to Amylin Pharmaceuticals, Inc. The Action once again rejected all the subject claims for obviousness and/or lack of novelty. The inter partes reexamination in the USPTO does not involve any of ConjuChem's patents.

Eppendorf initiates import ban against Nanosphere's Verigene and Verigene SP systems

Eppendorf has initiated an import ban for Nanosphere, Inc.'s Verigene(R) and Verigene(R) SP systems for infringement of European patent EP 1 179 180 B2, titled "Method for the identification and/or the quantification of a target compound". The import ban covers any and all imports of the respective products into any country of the European Union. Customs authorities are required to confiscate any violating products.

UNITAID to launch patent pool for HIV/AIDS drugs by mid-2010

The international drug procurement agency UNITAID on Monday unveiled plans to create a patent pool for HIV/AIDS medications to help increase access to generic versions of newer drugs at lower prices for low- and middle-income countries, Agence France-Presse reports. The patent pool "will create a common space for patent holders to license their technology in exchange for royalties" and is "scheduled to begin operating in mid-2010," AFP reports (12/14).
