Bloomberg: Obama Health Care Appeal Set For Atlanta Hearing June 8
Oral arguments are set for June 8 in the Obama administration's federal-court appeal of a ruling in a lawsuit filed by 26 states that struck down the president's health care legislation. The Atlanta-based appeals court, in a ruling published today, denied the states' request for a full-panel review of U.S. District Judge Roger Vinson's Jan. 31 decision and said a randomly selected three-judge panel would hear the challenge. Vinson said the Patient Protection and Affordable Care Act's requirement that almost all Americans obtain medical insurance starting in 2014 violated the U.S. Constitution. Finding the mandate inseparable from the rest of the act, he declared the entire measure invalid (Harris, 3/31).
ABC: Health Reform Will Face Important Test At June 8th Hearing
A Florida appeals court has scheduled oral arguments on June 8th to hear the Obama administration's appeal to a lower court ruling that threw out the entire health care law. The hearing will take place in Atlanta at 9:30 a.m. before a three judge panel of the 11th Circuit court of appeals (de Vogue, 3/31).
CNN: US Appeals Court Sets June Hearing On Challenge To Health Care Law
The 11th U.S. Circuit Court of Appeals in Atlanta is scheduled to hear oral arguments on the constitutionality of the nation's sweeping health care reform law on June 8, according to an order issued Thursday by the appellate court. The order grants the Obama administration's motion for an early hearing, which could enable the Supreme Court to get the case as soon as late this year or early in 2012. Two other federal appeals courts are considering separate but similar legal challenges to the legislation passed in 2009 (3/31).
