GLUMETZA patent infringement lawsuit against Lupin

Depomed, Inc. (Nasdaq:DEPO) today announced that it has filed a lawsuit in the United States District Court for the Northern District of California against Lupin Limited and its wholly-owned subsidiary, Lupin Pharmaceuticals, Inc., for infringement of the patents listed in the Orange Book for GLUMETZA® (metformin hydrochloride extended release tablets).

The lawsuit is in response to an Abbreviated New Drug Application (ANDA) filed by Lupin with the U.S. Food and Drug Administration (FDA) regarding Lupin’s intent to market generic versions of 500mg and 1000mg strengths of GLUMETZA prior to the expiration of the four listed patents (Nos. 6,340,475; 6,488,962; 6,635,280; and 6,723,340).

Depomed has commenced the lawsuit within the 45 days required to automatically stay, or bar, the FDA from approving Lupin’s ANDA for 30 months or until a district court decision that is adverse to the patents, whichever may occur earlier.

“We have full confidence in the intellectual property rights protecting our GLUMETZA products. We intend to vigorously defend and enforce our intellectual property rights, as we have in previous infringement actions,” commented Matthew M. Gosling, Depomed’s vice president and general counsel.

    I have taken metformin for about 5 years now. I have renal failure and my kidneys are only working 35%. I have to go thought alot of tests concerning my renal failer.

    my husband has been taking high doses of metformin for a few years. he just got out of the hospital and was told he had liver problems and needs and liver transplant now. he is very sick and does not have insurance because of pre existing conditions and now the hospital is denying him treatment. what do you do now?

    All long term studies of Metformin indicate that between 30 and 40 percent on  Metformin users of 4 years or more will develop a B12 deficiency. The longer and the higher the dose increase your chances. I was on Glucophage/Metformin for 12 years (High dose) and I developed a B12 deficiency which led to severe and irreversible nerve damage including Peripheral Neuropathy and Charcot foot. If you are on Metformin have your B12 levels checked yearly and avoid the pain.

    My mother is dying from Cirrhosis of the Liver from taking Metformin/Glucophage for Diabetes.  She is suffering and has had a Centesis (fluid withdrawn) done every 8 to 10 days. Her Liver has deteriated and cannot do its job. Each time she has the Centesis done, she has to have 4 units of protein antibiotic and at least 2 pints of blood.....this is an all day procedure. When she had her first one...6 months ago, they removed 6.5 liters of fluid.  It goes down steadily and now they only get about 3 liters.  She is 84 years young and a tea totaler!  This absolutely came from Metformin and I will be a part of the lawsuit!

    I am a diabetic who has been taking metformin for a few years and was also diagnosed with rheumatoid arthritis and have been on several meds including methotrexate (off now) and losartin for blood pressure along with low dose aspirin daily.  I've had to deal with inverse psoriasis and I think yeast since I've had peeling skin (which I thought was psoriasis) and there is an odor and a "film" that comes back no matter how much I shower or bathe.  I am very tired and have been having problems walking due to calcium deposits in my heels which did not respond to steroid injection or the other medication my foot doctor prescribed.  The pain in my heels persists and keeps me from sleeping well and having a normal life...my dad and mom had diabetes also - mother also had emphysema, went into coma, was on breathing assistance, died at 51 due to enlarged heart, dad eventually diagnosed with non-hodgkins lymphoma and passed at 71.  I am 65.  What should I watch out for ?  My son and grandchildren live with us and depend on me a lot.  Can't afford to take chances.
